'Removal of respirators from brain-dead
'Removal of respirators from brain-dead not permissible'

Riyadh: Grand Mufti of Saudi Arabia Shaikh Abdul Aziz Bin Abdullah Al Shaikh has affirmed that removal of respirators from brain-dead people and babies born with disability is not permissible since their hearts beat naturally.
Addressing a meeting of senior doctors in Taif city, he also said that it is prohibited to force prisoners sentenced to death to donate their organs and treat as brain-dead persons.
"It is right to execute them, but there is no right to cut a part of their organs," he explained. "It is wrong to take some parts of the body of a person sentenced to death and then carry out the death penalty on him. This is not permissible," he added.
Exploitation
The Grand Mufti declared as religiously illegal the attempts made by some doctors to exploit the patients by asking them to undergo unnecessary tests with the aim of making more money.
As for the Islamic opinion on forcing of a pregnant woman to undergo a caesarian operation, he said, "it is not allowed to treat a patient without her permission unless it is necessary to rescue her life or her baby's life".
Regarding abortion, he said that Islamic scholars unanimously agree that it is allowed only if a woman's pregnancy is 40 days or less.
He, however, added that this should be in a very limited manner only in case of fear from negative impacts of this pregnancy".
Asked about medical mistakes which lead to death of patients, he said "an experienced doctor should not be blamed for a mistake he committed unintentionally or without any sign of negligence".

| We hope that the Islamic scholars take due advice from the the professionalists before passing any verdict on as the prophet sws/pbuh himself avoided giving his verdict in the matters he was not expert in. |

If there is any specific objecion on the above fatwa, please do point out here so that I can take that up with the Saudi Scholars and invite them for a dialogue with your team of professionals Insha Allah.

its not the matter of right or wrong(athough there are things here like removing respirator etc which involves issues like economical, affordability etc on the part of relatives & individual circumstances and a universal fatwah cannot be applied everywhere.similarly the cosent for caesarean section-situations and circumstances vary all the time; or the time of miscarriage and various opinions ranging from 6 to 16 wks depending upon the actual organogenesis or the appearance of heart beat on scan or the time untill when amniocentesis or cordiocentesis can be performed for the diagnosis of anomalies i.e. 20 to 22 wks, etc-all of which are open to discussion and keep changing according to the changing technological developments etc) but my stance was to condemn this 'fatwa oriented attitude' of muslims in general which discourages self education and learning.
it's not a healthy sign that in every field of life we need a so called 'mufti' to hold our finger and keep telling us where to put the foot and which way to roll the eyes to.
ofcourse their knowledge and guidance is a great help & blessing available, but we must not try and drag them into every issue, rather must continue our self learning process as well with the help of the original sources available i.e. Qur'an and the practices of the prophet sws/pbuh and even on the work already done by these muftis and scholars based on original sources or by discussing with them as n wen. however we must not make self made barriers hirdles for us or our generations from learning. |

What is a fatwa?
It is nothing but a legal opinion or ruling issued by an Islamic scholar.

Sure. But at the same time we should not be content with what little we are able to learn in the little time we get after our duty and rest hours and should be prepared to discuss matters relating to Qur'an and Sunnah with those specialised in that field of study.
